Issuance of an environmental restoration order by the court of law.

Instances when a court of law could issue an environmental restoration order


• Both NEMA Inspectors and a court of law can issue an environmental restoration order.
• A person may complain and institute proceedings to a court of competent jurisdiction that the environment is being harmed or likely to be harmed by certain activities
• It shall not be necessary for a plaintiff to show that he has a right or interest in the property, environment or land alleged to have been or likely to be harmed
• The court shall consider the application and if convinced, could issue an environmental restoration order to the person implicated in these proceedings.
