Access permit violation penalties

Penalties for violation of access permit conditions

• Violation of any of the conditions of the access permit may compel NEMA to suspend, cancel or revoke it.
• Prior to suspending, revoking or cancelling an access permit, NEMA gives a written notice of its intention.
• NEMA also invites the permit holder to defend their permit within thirty (30) days from the date of the notice.
• Upon receipt of submissions, NEMA makes a decision on whether to suspend, cancel or revoke, or retain the permit.
• In the event that NEMA suspends, cancels or revokes a permit, it notifies the public of its decision by notice the Kenya Gazette and one newspaper with nation-wide circulation.
